Los Angeles Superior Court Judge Joanne O’Donnell today issued a ruling lifting the temporary restraining order against Center for Medical Progress.
O’Donnell ruled that biotech firm StemExpress that it cannot stop the Center for Medical Progress from releasing another Planned Parenthood video exposing the late-term, after-birth abortions and harvesting and procurement of fetal baby organs.
the temporary restraining order did pertain to one key meeting the undercover activists filmed and prevented them from releasing a video with any information from it. Now, according to ABC News, the judge in the case has issued a ruling lifting that temporary restraining order… …free speech rights should allow an anti-abortion group to release secretly recorded videos of discussions with a California company that provides fetal tissue for research….
UPDATE: 8/21 3:50 PM The ruling is now official. The court noted that even if Stem Express prevails on their Penal Code 632 cause of action, ‘there is nothing in [that code section that] prevents the publication of information unlawfully procured through unlawful privacy violations….’
While attorneys for StemExpress plan to appeal the ruling, Planned Parenthood who is alleging that the videos are illegal is threatening to sue the pro-life entity.
The Hill by Kevin Cirilli
Planned Parenthood Executive Vice President Dawn Laguens said she believes the videos are illegal and that her organization is ‘considering everything’ in going after the Center for Medical Progress, the group behind the videos.
‘I absolutely do believe that they have violated laws in terms of how they secured these videos,’ she said in an interview at the group’s Washington, D.C., headquarters. ‘But the fraud is also in how they have presented them and in the editing.’ ‘We are considering everything,’ she said….
Jumping into the fray, Elijah Cummings is using his bully pulpit to go after the Center for Medical Progress.
Rep. Elijah E. Cummings, D-Md., asked the anti-abortion group Center for Medical Progress in a letter Thursday whether it used donations in its undercover investigation of Planned Parenthood. Cummings also wants to know if lawmakers were aware of any potential illegal activities surrounding the years-long investigation into Planned Parenthood.
The letter serves as a counterweight to calls for an investigation into Planned Parenthood from the House Committee on Oversight and Government Reform, which Cummings serves as ranking member…..
If you are experiencing déjà vu, that is because Cummings overreached when he targeted True the Vote during hearings about the IRS targeting of Tea Party, Jewish, religious and other non-Progressive organizations.
