When his turn came to talk, had Brett Kavanaugh walked out to his desk, sat his notes down, then walked around the table and walked up to Dick Durbin and popped him square on the nose, he couldn’t have made his case more masterful.

He took off the gloves, which in the Republican world of Washington, no one ever considered an option anymore.

It’s Thursday, October 4. and the shock of the way Brett Kavanaugh made his case on Thursday, September 28, has still not worn off.

By Sunday, the Democrats were clearly no longer on offense. Kavanaugh was no longer an attempted rapist, a serious felony offender justifying many years in prison, (I’ve defended just such cases) but now a drunk…including some talk of being a bar brawler. Without using a shillelagh (stick) or driving a car recklessly, we’re now only talking about a misdemeanor, where jail time is rare indeed. Certainly no more punishment than Code Pink or Antifa gets for breaking up a congressional hearing.

Yes, though Kavanaugh has dropped from a felony rapist to a college kid who got loaded every weekend…but who always seemed to still get straight A’s anyway for seven straight years…and not those crip courses over in the Sociology Department either…the Democrats are still trying to keep the alleged violence of that original assault claim by portraying him as a violent drinker[…]

So when they say “the FBI, or DOJ or CIA said this, or did that” – your first thought should be, “Which one?” Especially if it’s the media telling you these things.

Also, never forget that is has been this way since at least JFK.

In 1998, a man asked me to help write a book directed at the very people who are now taking back the country, one piece of government at a time. I complained to him that he was asking me to write a book for people “who don’t read.” He said, “Yep.” He died in 2006, and I’ve been trying to write that book, one chapter at a time, ever since.

The Deep State

A little history: For all I know elements of the deep state have been around since Wilson. Those are the career bureaucrats who will move mountains to do things their way, and always protect their jobs, and grow their numbers when the opportunity arises. That’s just part of the human condition, and yes, the Founders understood this. It’s as in a bureaucracy’s DNA to want to do this as it is a deer’s need to rut every autumn.

If governments through the ages have had a fixed star, it would begin with their Bureaucracy.

In the debates over how the new Constitution of 1787 should look, one constant both Federalists and Jeffersonian Republicans seemed to agree was that the size and power of government should depend entirely on the people’s control of the men who both could increase the size and mission of government, and also raise the money to pay for it.

Despite their animosity towards one another, the Federalists and Republicans were of one mind about keeping the federal government very lean. The idea that the federal government should want to grow did not begin until the formation of the Democratic Party and Andrew Jackson, 1824-28, when the spoils system was first introduced…after all the lions had passed away.

But they finally got an income tax in 1913 (16th Amendment), (count the years, by generations, 126 and 4) which, while very, very small, its fine print enabled Congress to increase it almost at will, and then, 19 years later, 1932, with the Great Depression, and the next generation of Progressives called in to fix it, (FDR and the New Deal), the government grew like mushrooms in a rain forest. Many of those programs survived well into the 60’s, until LBJ could replace them with a new set of programs, The Great Society, which haunts us still[…]

The miracle of the Founding Fathers was not the Constitution so much that they created a document of self governance for people not of their class, and gave it away freely, no strings attached.

It was a gift!—but only, as Mr Franklin warned, “If we can keep it.”

This had never happened before in human history. I’m not even sure it had ever been contemplated before, but I’ll leave that for scholars to set the record straight.

This opening line opens up various forks in the road, several lines of inquiry, among them class as the Founders viewed it in the Colonies versus the rest of the educated world, and by comparison, in today’s world. Both are worthy of inquiry in light of what conservatism means today.

Then there is the nature of American specialness itself; our view of ourselves as exceptional, against the world’s majority view, held by its governments, based on at least 500o years of human history in which no idea even remotely resembling a government “by the people, for the people and of the people” could ever germinate and take root.

As I’ve written elsewhere, the “specialness of America” has always been viewed through two entirely different lens, one as a freak of nature, to be hated, and the other, as Man’s hope for liberty and rescue from a history of servitude to a master class.

This in turn begs yet another fork, the question: is America a miracle, and if so, from whose hands, the Founders or an Invisible Hand? Or maybe a collaboration? Billy Graham, who just passed away (RIP) believed in the role of an Invisible Hand, he even went so far to call it by Name. And I agree, only, it has been some years since some types of Christians have been invited to discuss this question with the intellectual right. As you know, on the key elements of liberty, I’ve even argued that Science and God are of one accord, than Man-the-animal needs and seeks it because it is survival-enhancing. But over the years I’ve noticed that the so-called intellectual right has never gone through that open door of inquiry.

Still, in all the years Man has trod this earth there has not been known to recorded history any other rising of a nation of peoples who became their own masters. As the lawyers would say, America was a “case of first instance.” And that was 231 years ago, and with our success, you’d have thought that at least some of the rest of the world would have stood in wonderment at what these people in America had wrought, and decided to try it out themselves. True, they paid lip service to many of our institutions, even adopting many of our terms, such as “Democratik”, a popular label from the mid-20th Century, to appease their masses. (“Hypocrisy is the price vice pays to virtue.”) But at no time did those states ever cut the ties between their ruling class and the ruled. In fact, some of the most virulent forms of governance known to history were brought forth in the two centuries since the founding of America, in part because of America’s mere existence and the threat it posed to autocracy’s 5000 year winning streak. (For proof, follow the genesis of modern masters candidates’ theses in the American academy, largely blaming all of society’s ills on the manner of our Founding.)

In Defense of Jerry Falwell, Jr’s “Theological” Apostasy

Salon.com said Jerry Falwell, Jr, president of Liberty University and son of Jerry Falwell, Sr, “had a very bad week”. Other left-wing rags echoed in.

You see, Falwell and other evangelical leaders have refused to condemn Donald Trump based on an allegation about some porn star named Stormy Daniels having had a fling with him while married to Melania.

This is why I’ve always been a fan of Salon, HuffPo, Vox, Newsweek, et al, for they are always interested in my soul even as they don’t believe in morality, or the soul, so don’t have to squirm over issues such as extramarital sex. To them, morality is like acne, it’s a skin condition about which one can stand from a distance and poke fun.

Law: Unlike those of the political world those in the spiritual world are far more nuanced in their judgments as they are taught to hate the sin but love the sinner.

This is why we are enjoined to love a couple of editors at National Review, David French and Jonah Goldberg, who joined in to echo the chorus at Salon, by chastising Mr Falwell for finding “forgiveness” of an “alleged” sin of doing the down-and-dirty with a women who apparently made a living being down-and-dirty. Their crimes; theological apostasy and rationalization.

Mine? Well, theological apostasy and rationalization.

“Judge not lest ye be judged” Jerry Falwell is quoted as quoting. None of the writers acknowledged, and those at National Review should know better, is that Jerry Falwell Jr is not a minister of the church, or even a seminary graduate, but rather a graduate of the University of Virginia Law School (where I did my Army legal training in the early 70s), and a fine law school it is.

And at UVA and in most courtrooms, the legal version of Christ’s “Judge not” admonition is “Judge not until there’s some real evidence offered.”

Since the Harvey Weinstein story broke, and actually the Russia probe into Trump collusion as well, we’ve been treated to what has become a mainstay in media reporting, and that is the power of the unproven allegation; the condemnation of people by facts not yet in evidence. A favorite subject of mine, actually, I’ve made a lot of reassessments of some of my favorite writers and publications based solely on their ability to “rationalize” (Goldberg’s words, not mine) their understanding of unproven allegations into near morally-certain  probabilities, and then move ahead armed with a vision of truth no one else around them has. Jonah’s right, it can rise to disease-level in short order, and there is actually no vaccine that can contain it. We just have to let it run its course[…]

(We rarely publish other men’s works here, but I want to introduce a singular mind to our readers, for he is a genuine scholar, yet shares the views we’ve written about for many years about the vacuousness of the media in general, and #NeverTrumpsters. Mr Taleb affirms the entire Media Narrative-as-History myth as being just that, and why so many modern younger conservatives especially, seem so intent on taking themselves so damned seriously. Mr Taleb is a grown-up.

What we have been seeing worldwide, from India to the UK to the US, is the rebellion against the inner circle of no-skin-in-the-game policymaking (suffer the consequences of his talks or suggestions?) “clerks” and journalists-insiders, that class of paternalistic semi-intellectual experts with some Ivy league, Oxford-Cambridge, or similar label-driven education who are telling the rest of us

1) what to do, 2) what to eat, 3) how to speak, 4) how to think… and 5) who to vote for.

But the problem is the one-eyed following the blind: these self-described members of the “intelligentsia” can’t find a coconut in Coconut Island, they aren’t intelligent enough to define intelligence hence fall into circularities — but their main skill is capacity to pass exams written by people like them.

With psychology papers replicating less than 40%, dietary advice reversing after 30 years of fatphobia, macroeconomic analysis working worse than astrology, the appointment of Bernanke who was less than clueless of the risks, and pharmaceutical trials replicating at best only 1/3 of the time, people are perfectly entitled to rely on their own ancestral instinct and listen to their grandmothers (or Montaigne and such filtered classical knowledge) with a better track record than these policymaking goons[…]
