The Thomas More Society has taken on a case on behalf of Andrew Cash, a student at Missouri State University who was dismissed from his M.S. in a counseling program after expressing concern over the counseling of same-sex couples due to his religious convictions.
The law firm filed a federal civil rights complaint this week against the Missouri State stating that Cash who began a counseling program at the university in September 2007 was discriminated against after responding when asked if he would counsel gay couple that he would cancel them individually but not as a couple because of his Christian beliefs.
SPRINGFIELD, Mo. (CN) — Missouri State University kicked a student out of its master’s program in counseling because his religious beliefs prevent him from counseling gay couples, the man claims in court.
Andrew Cash sued the Governors of Missouri State University, System President Clifton M. Smart III and other MSU officials on Tuesday in Federal Court.
MSU’s masters program requires 600 hours of clinical counseling, 240 of them face-to-face, according to the lawsuit.
Cash says in the complaint that defendant Kristi Perryman, former internship coordinator for the MSU Counseling Department, approved his internship at the Springfield Marriage and Family Institute (SMFI) in the fall of 2010 and that at least one student had successfully completed an internship at SMFI.
Each student is required to make a class presentation. Cash proposed to his instructor, nonparty Kara Davis, that he do his on Christian counseling and he made his presentation at SMFI on April 11, 2011.
During the presentation, a student asked SMFI Executive Director W.K. Boyce whether he would counsel gay couples. Boyce responded that he would counsel them on an individual basis, but not as a couple due to his religious beliefs. Boyce, who is not a party to the lawsuit, said he would refer gay couples to fellow counselors who do not share his religious beliefs.
A week later, Cash says, Perryman informed him that he was not allowed to continue interning at SMFI and that the organization would be removed from MSU’s approved site list until certain “ethical” concerns were addressed.
Cash says Perryman questioned him closely on whether he would counsel gay couples. Cash said he would counsel them individually but not as a couple due to his religious beliefs. Cash said he would refer them to other counselors who do not hold his beliefs….
What kind of a sick world do we live in that school officials in the UK or anywhere for that matter would ban a seven year old blind girl named Lily Grace (above) from using her cane out of fear that she might trip one of her classmates? It seems to me that the sighted can see Lily Grace and the cane, so what is the problem besides inept bureaucrats and control freaks discriminating against Lily Grace and trying to control her every movement.
BRISTOL, UK – Calling it a “health and safety” issue, a school in Britain has banned a blind girl’s white cane over fear that she might trip one of her classmates.
Lily-Grace Hooper, a 7-year-old who attends Hambrook Primary School in Bristol, United Kingdom, was notified that her cane posed a “high risk” to other students and she was no longer allowed to use it.
A risk assessment was conducted by Sensory Support Service and it was determined the girl would be better off with full adult support “100 percent” at all times, the Bristol Post reports.

An Office Depot in Schaumburg, Illinois discriminated against Christians and Pro-Lifers when it refused to print 500 copies of “A Prayer for the Conversion of Planned Parenthood” needed for Sunday mass.
Refusal to print the publication is Office Depot policy according to employee Karen Denning who defending the corporation’s policy stated that “the copying of any type of material that advocates any form of racial or religious discrimination or the persecution of certain groups of people….It also prohibits copying any type of copyrighted material…The flier contained material that advocates the persecution of people who support abortion rights.”
Maria Goldstein, 42, ordered 500 copies of “A Prayer for the Conversion of Planned Parenthood” at Office Depot in Schaumburg, Illinois, for distribution at her Roman Catholic parish’s Masses Sunday. The prayer was composed by national director of Priests for Life Father Frank Pavone, a Breitbart News contributor.
The handout, according to the Chicago Tribune, also included statistics about abortion in the United States and at Planned Parenthood, the nation’s largest abortion provider, which is currently under investigation by Congress after being exposed for its practices of harvesting the body parts of aborted babies and selling them on the open market….
A line in the prayer reads, “the evil that has been exposed in Planned Parenthood and in the entire abortion industry.”
For Office Depot, the truth is obviously a bitter pill to swallow.
The Thomas More Society contacted Office Depot, Roland C. Smith’s office on behalf of Maria Goldstein regarding its denial of service.
Apparently, Goldstein gave Office Deport several opportunities to rectify their denial of service to which Office Depot’s Customer Service remained evasive and uncooperative.
Diane Demma, Office of the Chairman, after receiving a copy of the flyer by fax contacted Goldstein and informed her “if it makes employees feel uncomfortable they don’t have to print something.’ She also stated that they are ‘working on a policy’ for situations like this….”
In actuality then, if an employee refuses to print specific material under these circumstances, then said employee’s denial of service is not based on his or her own volition.
The language used by Demma, “working on a policy’ for situations like this” suggests that Office Depot who is in the business of “public accommodation,”is attempting to cover itself because of its unlawful discrimination and denial of service to Goldstein based on “religion and perceived status.”
Office Depot is in violation of ordinance laws (see page 2 of letter, which can be viewed below, or here in pdf format).
What is going on in America when a bakery is put out of business for refusing to violate their faith by baking wedding cakes for homosexuals then Office Depot in support of Planned Parenthood who murders innocent babies then harvests and sells their body parts refuses to print prayer publications for Christians and pro-lifers.
Arby’s has taken action against two employees for an incident in which a uniformed police officer in Pembroke Pines, Florida was allegedly denied service earlier this week.
Kenneth Davenport, age 19, who allegedly refused to serve Sgt. Jennifer Martin, a police officer at the Arby’s in Pembrokes Pine Mall has been suspended indefinitely and manager, 22-year-old Angel Mirabal, terminated.
The two men were working at the restaurant, 11755 Pines Blvd., when Sgt. Jennifer Martin said she was told by Mirabal that Davenport refused to ring up her order after accepting her credit card.
‘He doesn’t want to serve you because you are a police officer,; Martin quoted Mirabal as saying.
Davenport said the comment from Mirabal was an attempt at a joke that backfired…
The incident sparked outrage throughout social media with demands calling for Arby’s to take immediate action against the employees. The Police Benevolent Association immediately called for a boycott of the restaurant chain nationwide.
Telling his side of the story in the video below, Davenport, a snarky 19 year old when asked about the incident immediately pulls the race card, “There’s no point in talking…because I’m 19 and she’s an officer…and I’m colored.”
Towards the end of the video, Davenport’s grandfather, Thomas McCutcheon, in defense of his grandson says, “And somebody made a joke and she just didn’t take it the right way.”
So it’s Sgt. Martin’s fault?
Mirabal says that his termination is “not fair,” it was a joke.
McCutcheon is seeking a meeting with Sgt. Martin and her superior in the hopes of “exonerating” his grandson. In the meantime, Arby’s “management wrote down all that he [Davenport] had to say, and decided that they will make a decision later on if they will permanently terminate him or if he’s just suspended,’ said McCutcheon. ‘All I want to do is clear his name and to get an apology in paper that he did not cause this problem.” Source: WSVN.
The Pembroke PD who considers the matter closed has received an outpouring of support from the community it serves.
Moreover, the Arby’s incident has triggered an outpouring of support from the competition, from McDonald’s to Whole Foods who put out a spread for the officers in addition to providing coffee and Dunkin’ Donuts.
The CEO of Arby’s reached out to Pembroke Pines police yesterday to issue an apology following a 19-year-old employee’s refusal to serve a uniformed police officer Tuesday night.

According to the offense report, Sgt. Jennifer Martin ordered take-out using the drive thru at an Arby’s located in the Pembroke Lakes Mall whereupon placing her order, the clerk at the drive-thru window “seemed slightly rude and short with his responses.”
Not thinking much about it, Sgt. Martin chalked it up to a faulty speaker system.
After driving around to the window, the clerk, Kenneth Davenport, took the officer’s credit card after which his superior, Angel Maribal approached the window and informed Sgt. Martin that “He [Davenport] doesn’t want to serve you because you are a police officer.”
Davenport refused to process the officer’s credit card.

Pembroke Pines Police Chief Dan Giustino issuing a media release said, “I am offended and appalled that an individual within our community would treat a police officer in such a manner. It is unacceptable, and I will be contacting the Arby’s CEO to demand an apology.”
WSVN: “Jeff Marano from the Police Benevolent Association also joined the conversation with comments of concern. ‘This is inexcusable behavior for an employee in an establishment to be treating a uniformed police officer or anybody in the public like that,’ said Marano….”
The incident sparked outrage across social media with calls for law enforcement and family members to boycott Arby’s nationwide.
Giustino contacted Arby’s which was promptly followed up by a response from Arby’s CEO, Paul Brown, and Senior Vice President of Operations Scott Boatwright, who issued an apology on behalf of the restaurant chain.
Arby’s issued the following statement, which I am sure, is elsewhere besides this little blurb on their Facebook page (screenshot below).
“We take this isolated matter very seriously as we respect and support police officers in our local communities. As soon as the issue was brought to our attention, our CEO spoke with the Police Chief who expressed his gratitude for our quick action and indicates the case is closed. We will be following up with our team members to be sure that our policy of inclusion is understood and adhered to.”
The clerk, Davenport, claims that the incident was “blown way out of proportion.”
Thomas McCutcheon, Davenport’s grandfather, said he’s taught his grandson to be respectful and said the incident was a misunderstanding that he hopes gets cleared up.
Davenport’s account, according to his grandfather, was that he became overwhelmed while taking drive-thru orders and asked his manager to help him. Davenport did not have a view of the intercom and surrounding area and did not know Martin was a police officer as she placed her order, his grandfather said.
As Mirabal assisted Davenport, Mirabal told the officer that Davenport did not want to serve her because she was an officer. Davenport told his grandfather that Mirabal meant it as a compliment to the female officer, indicating it was instead his pleasure to serve her….
According to the grandfather, Davenport meant it “jokingly.”
“Jokingly” like “pigs in a blanket….”????
“Somebody made a joke and she just didn’t take it the right way.” Davenport and his grandfather just laid the blame for the whole incident at the feet of Sgt. Martin…and race even though the officer he refused service and his manager are Hispanic. Moreover, a not so veiled threat to Arby’s and Pembroke Pines Police informing them that any actions taken against the clerk would be considered racist followed by a lawsuit for discrimination.
Of course, it was Sgt. Martin who was discriminated against because she is a police officer.
Finally, Arby’s manager did not show up for work the next day. Expect him to change his story.
